CHP may provide your name and other contact information (such as email address, mailing address or telephone numbers) to other merchants and cooperating members as a way to provide you with additional savings or to introduce you to money-saving offers. You hereby grant CHP an unrestricted, irrevocable, world-wide, royalty free license to use, reproduce, display, perform, modify, transmit, and distribute your contact information sent to CHP, and you also agree that CHP is free to use any ideas, concepts, know-how, or techniques that you send us for any purpose.

  5. Links or Pointers to Other Sites

    CHP makes no representations whatsoever about any other Website that you may access though this Site. When you access a non-CHP Website, please understand that it is independent from CHP, and that CHP has no control over the content on that Website. In addition, a hyperlink to a non-CHP Website does not mean that CHP endorses or accepts any responsibility for the content, or the use, of the linked site or that any linked site will be free of such items as viruses, worms, trojan horses, and other items of a destructive nature.

  6. Compliance with Applicable Law

    CHP is not acting as a mortgage lender, real estate salesperson or attorney at law. The goal of CHP is to save buyers of real property money and allow such buyers to purchase a home or other property with low monthly payments for the first 18-24 months. CHP provides a program whereby you (buyer) can experience significant savings with your residential, vacation or investment property purchase. While CHP intends to comply with all applicable federal, state and local laws, CHP is not your lender, your real estate agent or your attorney, and therefore you must make sure you and those working on your behalf are in compliance with all applicable federal, state and local laws. As with any significant investment, you should consult with your attorney and/or tax advisor before proceeding.

  7. Choice of Law and Venue

    These Terms and Conditions are entered into in the State of Idaho and shall be governed by and construed in accordance with the laws of the State of Idaho, exclusive of its choice of law rules. Each party to these Terms and Conditions submits to the exclusive jurisdiction of the state and federal courts sitting in the County of Ada in the State of Idaho, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. In any action to enforce these Terms and Conditions, the prevailing party will be entitled to costs and attorney fees. In the event that any of these Terms and Conditions are held by a court or other tribunal of competent jurisdiction to be unenforceable, those provisions shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect.

  8. Entire Agreement

    These Terms and Conditions constitute the entire agreement between CHP and you pertaining to the subject matter of this Agreement. If you obtain additional services from CHP or any of the merchants associated with CHP (including enrollment as a member of CHP’s website), you may have to enter into additional written contracts. You also may have to execute contracts with third parties, such as a real estate purchase agreement, a promissory note and deed of trust or mortgage, a construction contract and/or possibly others. Any subsequent written agreements between you and CHP which modify these Terms and Conditions shall be controlling but only to the extent of such modifications.

    In its sole discretion, CHP may modify these Terms and Conditions by posting the revised Terms and Conditions on this Site, which shall be effective as of the date so published.

  9. No Unlawful or Prohibited Purpose

    As a condition of your use of this Site, you warrant to CHP that you will not use the Site for any purpose that is unlawful or prohibited by these Terms and Conditions or any other written agreement between CHP and you.

    As part of CHP’s payment assistance program, CHP collects a certain amount of money from a willing property seller who agrees to sell their property at its fair market price less the amount paid to CHP. CHP uses most of the money collected from the seller to create the payment assistance fund. The balance of the money collected is used for administrative and other related expenses. With CHP’s help, buyers can purchase property with significantly reduced monthly payments for the first eighteen to twenty four months, all at no additional cost to the buyer. CHP does not promote or condone property sellers increasing the sales price above the fair market price in order to recover the money paid to CHP (and the nature of the competitive real estate market generally will not allow this to happen), but CHP does not engage its own appraisers or otherwise evaluate the selling price of any property. Buyers must arrange their own financing through a lender or broker who has enrolled as a CHP cooperating member to participate in the payment assistance program and must follow all lender or broker guidelines including full disclosure of the payment assistance program. CHP retains the right to refuse any transaction where lender or broker guidelines are not followed and/or full disclosure of the program is not given.

    Buyers are free to purchase any property advertised on the CHP website, but can only benefit from CHP’s Payment Assistance Program™ and associated discounts (such as the price or payment advertised on the CHP website) by taking advantage of financing through a CHP-cooperating licensed mortgage broker or lender, title or escrow company, and builder or seller.
